Searching Utah County Divorce Records Online

The Utah court system gives two main ways to search divorce records online. XChange is the state's subscription-based court records portal. A one-time signup fee of $25 applies, plus a monthly access fee. XChange gives you the ability to search case details, view dockets, and find basic filing information for Utah County divorce cases. Utah County Divorce Filing Process

To file for divorce in Utah County, at least one spouse must have lived in Utah and in Utah County for at least three months before filing. This is the residency requirement under Utah Code Section 30-3. You file at the Fourth District Court courthouse in Provo or at the branch closest to your address. The filing fee is approximately $330 for a new petition. Fee waivers are available for those with low income.

After filing, you must serve your spouse with the divorce papers. The court will assign a case number when you file. Utah law sets a mandatory waiting period before a divorce can be finalized. If you have minor children, the wait is 90 days. Without minor children, the wait is 30 days. During this time, both parties may attend a divorce orientation class as required by the court. Utah County Divorce Records Access and History

Utah County has some of the oldest divorce records in the state. The County Clerk has divorce and probate records going back to 1859, and court records from 1885. Marriage records go back to 1887. These older records are kept at the county level and may also be available through the Utah Division of Archives or through FamilySearch's Utah County genealogy resources.

Under GRAMA, the Government Records Access and Management Act at Utah Code Section 63G-2, most divorce records are public. The decree and court orders are open to the public. Some financial details and information about minor children may be redacted in public copies. Records that are 75 or more years old become fully open with no restrictions. You do not need to be a party to access public divorce records in Utah County.

Utah County Vital Records for Divorce

The Utah County Health Department at 151 South University Avenue in Provo, reachable at (801) 851-7005, provides marriage and divorce certificates for events recorded between 1978 and 2010. These certificates are shorter documents that confirm a divorce took place. They show the names of the parties and the date but do not include the full terms of the decree. Many people use certificates to prove marital status for things like remarriage or name changes in Utah County.
